Terms of service

Only registered guests may stay, and I won't exceed the guest count without permission from host. I'll follow all house, building, and HOA rules. No smoking, vaping, parties, or events. I'll respect quiet hours (8pm–8am) and neighbors. I'll park only in designated spots, and vehicles are at my own risk. Utilities are included for normal use. Use well above a typical stay may be billed after checkout.

Leave the home in good condition; I'm liable for damage and extra cleaning. I'll report any damage within 24 hours and flag existing damage on arrival. For longer stays of 30+ nights, a deep clean or professional cleaning before departure is appreciated to help with turnover.

I understand no refunds are given for weather or acts of God (storms, high surf, flooding). I also understand that tropical pests (chickens, geckos, critters) are normal island life and not grounds for a refund; I'll report any genuine infestation, which we'll address promptly with a professional. I have read and understand the cancellation policy for my reservation, as shown on the booking platform (Airbnb, VRBO) or direct booking website where I booked.

Waiver of Liability: (Injury & Death)

I understand that using this property carries inherent risks. Depending on the specific property, these may include the ocean and surf (no lifeguard on duty), as well as amenities that are available at some properties but not all — such as a pool, hot tub, sauna, cold plunge or ice bath, gym or exercise equipment, stairs, balconies or lanais, slippery surfaces, and other hazards. I understand that not all properties offer these amenities, and their mention here does not guarantee they are provided at the property I have booked. To the fullest extent allowed by Hawaii law, I voluntarily assume these risks and release Outlive Homes LLC (as property manager), the property Owner, and their respective affiliated companies and owners from liability for any injury, death, loss, or damage to me or anyone in my party, except in cases of gross negligence or willful misconduct. I agree to indemnify and hold them harmless from any claim brought by anyone I invite onto the property.

I understand that where a pool, hot tub, sauna, or cold plunge is provided, it is used entirely at my own risk, that no lifeguard is on duty, and that I am responsible for supervising all members of my party — especially children — in and around the water at all times. I will observe all posted rules, with no diving where prohibited and no glass near the water.

This is a separate, legally binding agreement between me, Outlive Homes LLC, and the property Owner. It applies in addition to — not in place of — the policies of Airbnb, VRBO, or any other booking platform. To the fullest extent permitted by law, these terms govern my stay directly and hold me liable under their own terms, independent of any platform's coverage, refund, or resolution process.

I authorize Outlive Homes LLC and the property Owner to bill me for any charges I incur under this agreement, including damage, additional cleaning, excessive utility use, fines, unreturned keys or equipment, and any other costs caused by me or my party. I confirm that I am at least 18 years old and am the responsible party for this booking and everyone in my group. I understand that the property manager may enter the property for emergencies, repairs, or to address a suspected violation of this agreement.

This agreement is governed by the laws of the State of Hawaii, and any dispute will be resolved in the courts located in the county where the property sits. If any part of this agreement is found unenforceable, all remaining parts stay in full effect. I confirm that I have read, understood, and agreed to every term above, and that typing my name serves as my legal electronic signature.
